MINNEAPOLIS (WCCO) — A 23-year-old Minneapolis man is in custody after severely assaulting an 18-month-old child and a woman last week, according to Minneapolis Police.

On the evening of Jan. 25, police officers responded to the report of a domestic assault in progress on the 5700 block of Sander Drive. While responding, officers were notified of a “serious threat” to the toddler at the same location.

When officers arrived, they made contact with a man who resisted officers’ attempts to get into the residence. Once inside, officers located the young girl with severe injuries. The mother of the victim was also located and had also suffered assault injuries.

The young victim was taken to the Hennepin County Medical Center and is currently in the Pediatric Intensive Care Unit with facial injuries, a severely fractured skull, bleeding on the brain and a severe brain injury.

The suspect, identified as Hussein Osman Birre, was arrested after the incident. Police say that as Birre was being taken from the home, he said, “She’s an angel. She’s an angel now.”

Birre was taken to the Hennepin County Adult Detention Center and now faces a felony count of first-degree assault and a misdemeanor count of domestic assault.

No Charges Against Archdiocese In Minn. Church Abuse

ST. PAUL, Minn. (WCCO/AP) — Ramsey County authorities will not be charging the Archdiocese of St. Paul and Minneapolis for its handling of the case of a priest who was later convicted of sexually abusing two children.

Ramsey County Attorney John Choi said they do not have sufficient evidence to file charges, based off new information.

Choi made clear Wednesday at a press conference that they would only be discussing the case of the Rev. Curtis Wehmeyer and how and when it came to their attention.

A police timeline shows that a church official followed the law by reporting the abuse within 24 hours. Still, Choi criticized the Archdiocese.

“Although today there’s no criminal liability for the specific facts presented here, I continue to be troubled by some of the church’s reporting practices that manifest and some of the other cases that are currently under investigation and in this case as well,” he said.

The Wehmeyer case is among several that have come to light in recent months that have raised questions about the archdiocese’s handling of problem priests over the years. Choi said in more recent cases, there’s been more cooperation from the Archdiocese regarding police investigation.

However, St. Paul Police Chief Tom Smith said there certainly could be more.

State law requires members of the archdiocese to report allegations of sexual abuse against a minor immediately, which means as soon as possible but not longer than 24 hours after they were told. St. Paul Police investigated the timeline to report in this case relating to Father Wehmeyer, which occurred in May and June of 2012.

Wehmeyer, the former pastor of The Church of the Blessed Sacrament on St. Paul’s East Side, was charged in September 2012 and pleaded guilty that same year to criminal sexual conduct involving two brothers. Wehmeyer also pleaded guilty to having child pornography and is now serving a five-year prison sentence.

The charges said Wehmeyer molested one boy and exposed himself to the other in the summer of 2010. Wehmeyer was removed from his parish post in June 2012 after church authorities learned of the allegations.

But internal church documents show archdiocese leaders knew well before then that Wehmeyer had issues with sexual misconduct. In 2008, a church employee who was reviewing priest files warned church officials that Wehmeyer’s file contained documents noting he had a sexual addiction and had violated the archdiocese’s code of conduct several times. Among other things, Wehmeyer had solicited young men for sex in a bookstore and had cruised a park for anonymous sex.

But despite that, he was allowed to remain in ministry and was promoted to pastor in 2009.

In a Sept. 27, 2013, letter, Archbishop John Nienstedt said he didn’t suspect Wehmeyer was a risk to children when he named him pastor and it was clear in hindsight that Wehmeyer shouldn’t have been in active ministry. He apologized for not handling the matter more aggressively.

Attorney Jeff Anderson who represents Wehmeyer’s victims says Archdiocese officials should have been charged for covering up past allegations.

“It’s a very disturbing day,” he said.

Anderson lashed out against former Vicar General Kevin McDonough, who documents show told Wehmeyer he was about to be arrested. Wehmeyer then removed his trailer from the church property.

“There was an active obstruction of justice by Kevin McDonough and Archdiocese officials,” Anderson said.

Choi said no action would be taken against McDonough or other officials because their actions did not interfere with Wehmeyer’s prosecution.

There will also be no charges in another high profile case involving a local priest, Father John Shelley. A letter from the Washington County Attorney says none of the images on Shelley’s computer contained child pornography.

The Archdiocese released a statement saying it is gratified for the “clearing of the cases involving Wehmeyer and Shelley” and continue to cooperate with all investigations.

Through his attorney, Father Shelley said he is pleased with the decision and looks forward to a life free of unfair suspicion. McDonough could not be reached for comment.

Man Charged With 2nd-Degree Murder In Shooting Death

MINNEAPOLIS (WCCO) – The Hennepin County Attorney’s Office has charged a 20-year-old man with second-degree murder, in connection with the shooting death of a Good Samaritan who was trying to help him.

Devon Derrick Parker was charged Monday afternoon in the incident. And this isn’t his first run-in with the law. Parker has several past felony assault charges against him.

He was in court Monday for one this past September. In that case, he’s accused of assaulting medical professionals and officers who were trying to get him to a hospital because he was too drunk to function.

Police paperwork shows Parker’s girlfriend called police to check on his welfare as he was so under the influence of alcohol that he jumped out of a moving vehicle and took off.

Police called paramedics because they thought Parker was drunk and in a state of “excited delirium.” He also tried to assault, spit on and bite the paramedics. Two officers were injured in the incident.

But on Friday, police say a violent past escalated to the worst level.

Parker beat on the door of 69-year-old Thomas Sonnenberg’s north Minneapolis home. Parker was yelling that someone was trying to kill him, so Sonnenberg let him in.

Hennepin County Attorney Mike Freeman believes Parker somehow managed to grab a gun that Sonnenberg was wearing.

“The gun, which we believe was used to kill Mr. Sonnenberg, was a gun that Mr. Sonnenberg normally carried,” Freeman said. “He apparently took the loaded gun off of Mr. Sonnenberg’s hip and shot him in the head, killing him.”

The complaint says Parker was angry that he was locked inside, and took that anger out on Mrs. Sonnenberg.

The victim’s two grown daughters spoke out on Sunday after they found out what happened on Friday.

“He was not kind to my mother during that time before the police got here,” said Rachel Baufield, Sonnenberg’s daughter.

They declined to comment further on Monday.

Sonnenberg’s family is very confused as to why Parker was on the streets based on his criminal history, and they just want to know why this happened to their dad.

“He let him in and locked him in the house with my mom and him to save this man and protect his life,” Baufield said.

The victim and suspect lived about two miles apart, but it’s unclear why he chose that house.

“We know that my Dad thought he was saving somebody. He thought that this man’s life was in danger, that’s why he let him in,” Baufield said.

Parker’s expected in court again on Tuesday, where he likely will be charged in this case.

MINNEAPOLIS (WCCO) — The 14-year-old boy accused of stealing a school bus Monday and crashing it into a gas station has been charged.

The Ramsey County Attorney’s Office charged the boy with felony motor vehicle theft and two charges of criminal damage to property in connection with the incident.

Roseville police officers were dispatched to a Shell gas station at 7:51 a.m. Monday, located on 2154 Dale St. on the report of a stolen bus. Upon arrival, police officers encountered a man who had taken the boy into custody for the theft of a Centerline Charter school bus.

Officials say the driver of the school bus left it unattended for 20 minutes while she went into the gas station to get a cup of coffee. That’s when the boy hopped in and drove it for a few miles, claiming he was trying to return it to its rightful home.

When he ran into traffic on Dale Street, he drove the bus into the gas station but failed to navigate around the gas pumps.

The boy made his initial court appearance on Tuesday, and against the recommendation of the state, he was released into the custody of his parents under the supervision of the Ramsey County Intensive Supervision Program.

His next court appearance has been set for March 6.

MINNEAPOLIS (WCCO) — A 64-year-old Minnetonka man has been accused of stealing clients’ refund money and committing other crimes while working as a tax preparer, the Minnesota Department of Revenue announced Wednesday.

The Hennepin County Attorney’s Office recently charged John William Zastrow with four counts of identity theft and 24 counts of filing a false tax return.

According to the criminal complaint, Zastrow was working as a tax preparer when 92 deposits containing his clients’ refunders were issued to his bank account. He allegedly listed his address and bank account number in place of his clients’ on their tax returns, which also included false information to inflate the size of the refunds.

The attorney’s office says Zastrow kept more than $31,000 of his clients’ refund money between 2008 and 2012.

If convicted, Zastrow could face up to five years in prison for each false tax return charge and up to 10 years per identity theft charge.

ST. PAUL, Minn. (WCCO) — A 30-year-old man is charged with second-degree attempted murder after a shooting at a popular downtown St. Paul sports bar Friday night.

St. Paul Police responded just after 11:30 p.m. Friday to Tom Reid’s Bar on 258 W. 7th St. on a report of a shooting. Upon arrival, officers found the victim laying on his back on the ground, with a gunshot wound to the chest.

The victim was conscious and able to tell police the shooter was an acquaintance, identified as Patrick Timothy Juetten, of Woodbury, Minn.

According to the criminal charges, the shooting occurred outside the bar, on the patio. A witness said he was having a cigarette and talking to his friend when Juetten came up behind them with a “pissed off look” on his face.

The witness told police Juetten pulled out a gun and pointed it at his friend but his friend laughed it off, saying he knew Juetten. Juetten then put the gun back in his coat pocket, according to charges.

The witness told police he walked back into the bar and a short time later, was told his friend had been shot.

Police spoke with the victim in the hospital who said he knew Juetten from high school, where they played hockey together. He said Juetten called him out of the blue and they agreed to meet at Tom Reid’s. He said Juetten was trying to pass himself off as a cop, wearing a fake badge and carrying a handgun. He told the victim he wanted to “rob drug dealers” and tried to talk the victim into participating.

When the victim refused, he said Juetten shot him in the chest from about two feet away, according to the charges.

Medics transported the victim to Regions Hospital, where physicians say the bullet entered his chest at close range, pierced his lung, broke a rib and entered his liver, doing extensive damage. He’s said to be stable, but the injuries to his liver are extremely serious, according to the complaint.

Woodbury Police located and arrested Juetten on Saturday at a hotel he and his girlfriend had checked into, which was near his residence.

Juetten told police he was at Tom Reid’s and had been drinking a lot. He said he gave his car keys to a stranger so the man could get cigarettes out of his vehicle and that he had the handgun in the car. He said the stranger came back with his handgun and shot the victim at close range. He told police he panicked and fled the scene — and that he didn’t know what happened to his gun.

If convicted, Juetten could face up to 20 years in prison.

Officers arrested Patrick Timothy Jeutten, 30, in connection with the shooting of his acquaintance, whose name has not been released.

MINNEAPOLIS (WCCO) — Two men were charged Tuesday after police say they beat and robbed a man in the locker room of a Life Time Fitness in Eden Prairie, according to the Hennepin County Attorney.

Dalal Bayle Idd, 18, and Kamal Elyas Maqadin, 26, of Shakopee, Minn. were charged with first-degree robbery in the incident that occurred on Sunday. Idd was also charged with third-degree assault.

According to the charges, officers received a 911 call around 5:50 p.m. Sunday at the Life Time Fitness on 6233 Baker Road. Upon arrival, they met with the victim who was barely conscious and bleeding from injuries to his face.

He had multiple lacerations and his eyes were swollen shut. He was unable to speak to officers and was transported to the hospital. He suffered a nasal fracture, among other injuries.

The charges state Idd and Maqadin entered the locker room and approached the victim. Idd then repeatedly punched the man before taking his wallet and fleeing, according to the complaint.

A witness was able to get the license plate off their vehicle, as the two men drove away. Police watched surveillance video from the gym and recognized Idd, from prior contacts.

During the officer’s investigation, a second assault was reported a few blocks away. Witnesses to the second assault gave a description of the suspect that was similar to Idd.

He has also been charged with burglary and assault in that case.

Both suspects were located at a nearby apartment building and placed under arrest. Police say Idd was bleeding on his knuckle and there appeared to be blood on his pants.

The Life Time Fitness victim’s wallet was also found in Idd’s pants pocket, according to the charges.

Idd admitted to police that he went into the locker room with the intent of robbing someone and punched the victim five or six times in the face.

Both men are expected to make their first court appearance on Wednesday.

Idd is also accused in other assault cases currently under investigation, including against a detention deputy that occurred on Monday, according to the complaint.

MINNEAPOLIS (WCCO) — A 22-year-old man faces charges after police say he took his 2-year-old boy to a “dope house,” where the boy became high, after another individual was smoking meth in front of him.

According to the criminal complaint, police met with Joseph Michael Ray, of St. Paul, on Sunday after being called to Children’s Hospital regarding a child placement. Upon arrival, the boy was being cared for by medical staff who said the toddler appeared to be high on something.

The boy was lethargic and unresponsive when he was brought to the hospital by medics, according to the charges.

Ray told police he has been caring for the boy at his grandmother’s house for the past five weeks. He said he took his son to a “dope house” across the street from his grandmother’s residence, on the 600 block of East Jessamine Avenue in St. Paul about two days ago.

Ray said one of the residents at the “dope house” was smoking meth and acknowledged he and his son shouldn’t have been there, according to the charges.

Ray said his friend’s mother gave his son some Tylenol after noticing the boy looked “kinda sick.” Later that day, Ray said the boy “got really sunk-eyed.”

Ray said the boy went to sleep around 12:30 a.m. and appeared to be in a deep, deep sleep. He and his father tried to wake the boy but he was pale, dehydrated and had chapped lips, according to the charges.

Officials say the toddler has a positive screen for the presence of amphetamine in his system.

Ray was arrested and charged with endangerment of a child, as well as violation of a domestic abuse, no contact order. On Feb. 7, Ray was sentenced on a count of felony terroristic threats in Ramsey County.

MINNEAPOLIS (WCCO) — A 34-year-old St. Paul man has pleaded guilty to fleeing police and crashing into a vehicle, killing one person and seriously injuring another, according to the Hennepin County Attorney Mike Freeman.

Yia Her will be sentenced April 10 in the Sept. 9 fatal crash. He also pleaded guilty to aggravating circumstances of having been on parole at the time and driving on a suspended license with no insurance. By pleading guilty, the county attorney’s office can seek a prison sentence longer than required by the Minnesota Sentencing Guidelines.

The incident happened just before 1 a.m. Monday on 4th Street SE and Central Avenue in Minneapolis.

A trooper initiated a traffic stop on a white 1997 Nissan Maxima for speeding and suspicion of drunk driving. After initially stopping, the driver waited until the trooper approached his vehicle before fleeing the scene through Minneapolis.

The trooper tried at least four times to use a pit maneuver to end the chase.

The suspected drunk driver, identified by authorities as Her, crashed into a black 2000 Oldsmobile Intrigue at 4th Street and Central Avenue during the approximate three-minute chase.

The driver of the Oldsmobile, 20-year-old Brody A. Sotona of Spring Valley, Wis., was killed in the crash. His passenger, 24-year-old Connor Macklin of Stillwater, suffered serious injuries, including possible permanent damage.

According to the charges, Her’s blood alcohol content registered 0.16, which is twice the legal limit.

During his guilty plea, authorities say Her launched into a “rambling speech” through an interpreter, saying in part, “at that time I was so drunk I didn’t know what I was doing.”

Her’s lawyer asked him a series of questions regarding the incident, but Her started each answer with, “I was so drunk.”

Her eventually admitted that he knew a police officer was chasing him and that the officer hit his vehicle several times in an attempt to get him to pull over. Her then said in court that he continued driving until he ran a red light and struck the vehicle driven by Sotona.

MINNEAPOLIS (WCCO) — A 28-year-old woman has been charged in connection with a man found shot to death in south Minneapolis.

The Hennepin County Medical Examiner identified the victim as 23-year-old Anthony Lee Fairbanks of Minneapolis. He died from a gunshot wound to the head. His death has been ruled homicide.

According to Onyelobi’s criminal complaint, she was the last person to talk to Fairbanks and was concerned with him talking to police about her recent drug arrest. Police also discovered she had visited her storage locker before the shooting to grab a 9mm handgun in a safe.

MINNEAPOLIS (WCCO) — Charges have been filed against a number of people – including a father and son – in connection to the death of a Dawson teenager who fled an underage drinking party and died of hypothermia, the Lac qui Parle County Attorney’s Office announced Monday.

The incident happened on March 9 after the Lac Qui Parle Sheriff’s Office was called to the 2700 block of 280th Street at about 12:30 a.m. in rural Madison, Minn., on an underage party with alcohol. About 20 vehicles were parked on a farm site and when authorities arrived, 18-year-old Michael Anyasike was one of many to flee the scene.

He went missing and was found 12 hours later about a mile from where the party took place. He was taken to a hospital and pronounced dead. He played football for Dawson-Boyd and was planning on attending St. John’s University.

WCCO’s Angela Davis spoke to Anyasike’s mother the day after his body was found.

“He was a happy person all the time. He had a smile on his face and he loved his friends and he loved football,” she said.

Now, Lac qui Parle County Attorney Richard Stulz says 19-year-old Erik Hastad turned himself in and was charged with a gross misdemeanor contributing to the delinquency of a minor. Both he and his father, 59-year-old Gary Hastad, were charged with violating the social host ordinance.

Authorities are alleging that Hastad, who has prior minor consumption convictions, held the party and his father — who wasn’t present during the party — “should have known what was going on.”

The others charged include: 20-year-old Derek Rodeberg of Montevideo, 20-year-old Zachary Flickinger of Madison, Minn., 19-year-old Kaitlin Rae Johnshoy of Dawson, 19-year-old Matthew Stratmoen of Dawson, 18-year-old Ethan Young of Floodwood and 19-year-old Austin Olson of Appleton. They were all charged with fleeing a peace officer by a means other than a motor vehicle and underage consumption. Their BAC levels ranged from 0.18 to 0.177.

Hastad was expected to appear in court and be released on recognizance subject to standard conditions late Monday morning. The others are scheduled to appear on April 7.

MINNEAPOLIS (WCCO) — A 53-year-old St. Paul man faces serious charges in connection to the beating and rape of a hearing-impaired woman Friday, according to the Ramsey County Attorney’s Office.

Michael Darnell Burns was charged with two counts of first-degree criminal sexual conduct, third-degree criminal sexual conduct, terroristic threats and domestic assault by strangulation – all felonies – in connection to the March 28 incident.

According to the criminal complaint, a security guard at The Redeemer’s Arms Apartments on 313 Dale St. N. in St. Paul called 911 after a hearing-impaired woman accused Burns of assaulting her in his apartment.

The victim told police that she was visiting Burns when he got upset and physically assaulted her. After assaulting her, Burns allegedly raped her. The victim also said that Burns choked her three different times, causing her to pass out.

Witnesses at the apartment reported hearing loud noises coming from Burns’ apartment at around 1:45 a.m. When the neighbor opened his door to check the common hallway, he saw a completely naked woman run from Burns’ apartment, waving her arms. The neighbor retrieved a blanket and covered her up.

Authorities say Burns, in a Mirandized statement, said that the victim had been staying continuously with him for three or four days before the incident and that they had sex several times over that time. He said the victim had been drinking and getting too loud, eventually leading him grab her by her arms and throw her naked into the common hall. He denied punching or raping the victim.

In 1996, Burns was convicted of first-degree criminal sexual conduct and continues to have to register as a sex offender.

If convicted, Burns could face more than 30 years in prison.

MINNEAPOLIS (WCCO) — A 24-year-old woman has been charged in connection to the 40-mile high-speed police chase that began in Minneapolis and ended near Jordan, Minn. Monday, the Hennepin County Attorney’s Office announced.

On Wednesday, Diane Roberta Chosa was charged with fleeing a peace officer in a motor vehicle, which is a felony.

Minneapolis Police spokesman John Elder said officers initially noticed suspicious activity at the intersection of 36th and Fremont in north Minneapolis Monday. When Chosa saw police, she took off.

“A pursuit ensued, multiple agencies were involved including the State Patrol and the State Patrol helicopter,” Elder said.

The chase began on Interstate 394 and eventually ended on Highway 169 in Jordan when the car broke down. Chosa allegedly got out of the car and tried to run but was quickly apprehended. No one was hurt in the incident.

The passenger was not charged.

Chosa is expected to make her first court appearance Thursday.

Augsburg Student Faces Rioting Charges After Dinkytown Mayhem

MINNEAPOLIS (WCCO) — The only person facing serious charges after Saturday’s Dinkytown disturbance made his first court appearance on Tuesday.

Michael Conley Juberian, 22, is an Augsburg College student and is now facing two charges, including second-degree rioting with a dangerous weapon and fourth-degree assault of a peace officer.

Last Saturday, 20 people were arrested in Dinkytown after the Gopher men’s hockey team lost the NCAA game to Union College. Police received reports of arson and property damage. Some of the arrested were either let go or cited.

The crowd of hundreds ignored the warnings of possible arrests the day before from University of Minnesota school officials and Minneapolis Police.

According to the criminal complaint, Juberian and a number of others started throwing bottles at Minneapolis Police officers. He also threw rocks and chunks of baseball-sized concrete at police who were trying to control the large crowd.

Juberian’s attorney says his client was arrested more than two hours later coming out of The Library Bar near 13th Avenue and 4th Street SE. The complaint states officers subdued Juberian with a “stun blow.”

“I’m a little concerned that out of 20 arrests, one Augsburg student is charged with a felony for rioting,” said Juberian’s attorney Timothy Shields. “It seems to us either everybody was rioting or nobody was rioting.”

The rioting statue requires at least three people to be assembled and disturbing the peace by intentionally acting with unlawful force or violence to police. So far, Juberian is the only individual facing charges.

“So we’re a little concerned here, how he’s been singled out as a public policy matter,” Shields said. “And we don’t know who the other two people are. It seems to be only him.”

On Tuesday, Juberian was released on $20,000 bail with the conditions that he makes all his court appearances, remains a law-abiding citizen and stays out of Dinkytown.

MINNEAPOLIS (WCCO) — Two people have been charged in connection with a TCF Bank robbery in Burnsville and are suspected in another bank robbery in Maple Grove.

On Wednesday, 50-year-old Rory Alan Mitchell was charged with one count of robbery while 43-year-old Kimberly Anne Hillage was charged with one count of aiding an offender in connection with the April 15 bank robbery. Both have no known home address.

According to the criminal complaint, at 4:15 p.m. on the day of the incident, Burnsville Police responded to a robbery at the TCF Bank. Mitchell allegedly entered the bank earlier, approached the teller and displayed a handwritten note that demanded money. He also verbally demanded money before fleeing with an undisclosed amount of money.

An investigation revealed that the robbery suspect, Mitchell, matched the description in another robbery at Wells Fargo bank in Maple Grove.

Later, a Burnsville hotel employee recognized surveillance images released and told police a hotel room was rented by Hillage and a man, Mitchell, was also at the hotel every night. They checked out two days before the TCF Bank robbery.

Mitchell and Hillage were arrested in Minneapolis on April 21.

Dakota County Attorney James Backstrom thanked law enforcement agencies for the investigation and the quick arrests.

“This was a great example of cooperative and outstanding police work by multiple local law enforcement agencies and the FBI. Detectives were persistent and worked well with other agencies to swiftly apprehend the suspects in these bank robberies,” Backstrom said.

Mitchell made his first court appearance Wednesday where his bail was set to $300, 000 without conditions and $250,000 with conditions.

Hillage’s first court appearance was also Wednesday and her bail was set to $100,000 without condition and $75,000 with condition.

Both are set to return to court on May 20, 2014.

MINNEAPOLIS (WCCO) — A 35-year-old West St. Paul man is accused of cutting his girlfriend with a steak knives during an argument last week.

Raymond Everett Hill was charged with second-degree assault – a felony – in connection to the April 20, 2014 incident.

According to the criminal complaint, at 4:30 p.m., West St. Paul police officers were dispatched to the Hennepin County Medical Center on the report of a domestic violence incident. There, the female victim with cuts on her arm and face told police there was an argument between her and her boyfriend, Hill, at their apartment.

She said Hill got two steak knives during the argument and began pushing her out of the apartment while cutting her with the knives. The fight eventually calmed down and the victim returned to the apartment to grab some items. However, Hill became angry again, pushed the victim onto the bed and tried to wrap his hands around her neck, which resulted in scratches on the victim’s face, the complaint said.

When officers responded to the apartment, they were able to speak with Hill on the phone. He told police that he was in Minneapolis, but officers could hear the patio door of the apartment open. Hill was located a short distance away – with blood on his face and arms – and was arrested, the complaint said.

Hill later admitted to grabbing the knives during the argument and that the victim had gotten in the way and was cut while he was pushing her out the door, according to the complaint.

Police officers later found two steak knives in the kitchen garbage along with a cleaning towel that smelled strongly of cleaning solution.

If convicted, Hill could face a potential maximum sentence of seven years in prison and/or a $14,000 fine.

MANKATO, Minn. (WCCO/AP) — A man arrested in a weekend assault that severely injured a former Minnesota State, Mankato, football player has been charged with two felony counts.

Police arrested 21-year-old Trevor Stenner Shelley on Monday, hours after they released surveillance video showing him running from the scene in downtown Mankato.

Former Minnesota quarterback Philip Nelson is already charged with two counts of felony assault. A criminal complaint says Nelson kicked 24-year-old Isaac Dallas Kolstad in the head after Shelley punched Kolstad, knocking him to the ground.

Shelley has been charged with first- and third-degree assault, which carry maximum respective penalties of 20 and 5 years in prison upon conviction.

Nelson’s attorney has said his client was not the aggressor and that it’s not clear who caused Kolstad’s injuries.

The criminal complaint lists accounts from different bystanders. A girl who had been out drinking with Nelson and who, like Nelson, was under 21 said that he became enraged after a bouncer kissed her on the hand.

A friend of the victim’s said Kolstad and Nelson were engaged in a “heated exchange,” but it was not clear to him whether the fight was actually about Kolstad. The friend said that as he was trying to diffuse the situation with Nelson, someone else knocked Kolstad down. At that point, Nelson pushed past him and kicked Nelson in the head at least once, possibly twice.

Police said surveillance video shows Kolstad striking Nelson on the shoulder from behind while Nelson and the girl were talking with Kolstad’s friend. At that point, a male later identified as Shelley knocks Kolstad down with a punch to the head, investigators said.

Nelson said that he didn’t know the person who punched Kolstad, but officers saw that both Nelson and Shelley were friends on Facebook, and had both attended the same high school.

After being identified, Shelley informed police that he hadn’t struck Kolstad but, rather, that Kolstad had taken a swing at him.

Kolstad’s family said on its CaringBridge website that a surgery Kolstad had on Tuesday morning went well. He was still in critical condition.

MINNEAPOLIS (WCCO) — Two Minneapolis men are in custody accused of luring and shooting at a vehicle containing a woman and four small children, one of whom was seriously injured in the eye, according to Minneapolis Police.

On Sunday at 11:35 a.m., Minneapolis Police responded to the Hennepin County Medical Center on the report of a personal vehicle on the way to the hospital with a seriously injured person inside.

Upon arrival, officers encountered the vehicle with “obvious damage” to its windshield and the side window smashed out.

After securing the three children still inside the vehicle, police found the driver and a girl who suffered serious injuries inside the hospital.

According to the criminal complaint, a man identified as 21-year-old Diontre Ramone Hill called the woman earlier and asked her to meet him in an alley near 4232 Irving Avenue North, saying it was an emergency and that he was locked out of his house.

When the woman arrived, she told him to hurry up because she had to drive to basketball, but Hill appeared to be stalling. He then asked her if she damaged a car belonging to a female acquaintance of his.

After she denied damaging the other car, Hill made a call. That’s when a man known to the victim as 20-year-old Myles Ray Estes appeared and started running toward her car. Estes accused her of damaging the car, picked up a brick and began breaking windows of her car. Meanwhile, Hill did not intervene and appeared to be smirking, the complaint said.

When she began to drive away, she saw Estes running across a lawn with a handgun. As she drove by Estes, he fired at the car multiple times, smashing another window.

“Broad daylight, we were just sitting out here just talking cleaning out the backyard,” said one witness who lives nearby. “I thought it was fireworks. Then, we saw the black car go, like speed, down the street and then we saw another person run around the corner.”

During the shooting, one of the children began screaming that she could not see.

“The glass broke and injured one of the girls, the 8-year-old girl, by lodging shards of glass into her eye,” Minneapolis Police spokesman John Elder said. “The glass broke and injured one of the girls the eight year old girl by lodging shards of glass into her eye.”

The child was later found to have a very serious injury due to glass shards lodged in her eye and may have also received a glancing bullet wound to her head. Doctors say she may lose her eye.

Police went back to the area of the shooting and arrested Hill and Estes. Officers found a handgun and ammunition after executing a search warrant.

Hill and Estes each face one felony count of first-degree assault.

“Both are charged with first degree assault which is the highest level of assault before you start getting into manslaughter attempted murder and murder,” Elder said.

If convicted of their charges, both men could face up to 20 years in prison and/or a $30,000 fine.

The little girl who was shot turned 9 years old Wednesday. She has had two surgeries since Sunday and right now is in intensive care surrounded by family. They are asking for privacy, prayers and hope her sight will be saved.

A fund has been set up to help the family. If you want to help, you can donate at any US Bank. Donations are accepted in the victim’s name: Anaia Callender.
